NIL State Law Checklist

Use this checklist to ensure you understand the NIL regulations for the state where you currently live or may attend college.

• Each U.S. state can have different NIL laws.

• Does my state has its own NIL legislation or follows school/NCAA rules only?

✔️ School Involvement

• Can schools in my state involved in arranging or negotiating NIL deals?

✔️ Endorsement Restrictions

• Does my state have restrictions on the types of businesses I can endorse (e.g., alcohol, gambling, adult products, etc.)?

✔️ Contract Requirements

• Does my state require contract rules, such as:

  • Whether contracts must be in writing?

  • Whether contracts must be reviewed by the school?

  • Whether I need professional representation?

✔️ Disclosure Requirements

• Do you know which disclosures to make (and to whom), such as:

  • Reporting deals to your school?

  • Reporting them before or after signing?

  • Sharing contract details?

✔️ If Considering Colleges in Other States

• Have you researched NIL laws in any state where I might attend college?

• Have you asked the school’s compliance office to explain state-specific rules?
