Checklist to be cautious with NIL Contracts

Use this checklist before signing any NIL agreement to make sure you understand what you’re committing to.

✔️ Contract Length

  • Do you know how long the contract lasts?

  • Do you know if the agreement extends beyond your college career?

  • Do you know how to end or exit the contract (termination clauses)?

✔️ Exclusivity Clauses

  • Do you know if the contract requires exclusivity (working only with this brand in a category)?

  • Does exclusivity limit future opportunities for you?

✔️ Payment Terms & Deliverables

  • Do you know exactly what the contract calls you to do (posts, appearances, events, etc.)?

  • Do you know how much you will be paid and when payments occur?

  • Does payment depend on specific deliverables or performance?

✔️ Legal Review

  • Do you have an attorney, certified advisor, or qualified representative review the contract—or plan to retain one?
